Article 1 : Scope and changes in general terms of sale (modified on the 23rd of august 2006).

registered in « Registre des métiers, du commerce et des sociétés » in Pau as SIRET number : 487 47703600015 and named « Jolilola », And any physical or moral person who would like to purchase via Jolila.com website, who will be called below « the customer ».
These terms of sale concern any item ordered on Jolilola.com website.
Any purchase of a good or service via this website implies that you agree with all the sale conditions listed below.
These terms of sale will prevail any other general or particular terms that would not have been accepted by Jolilola.
Jolilola can adapt or modify at any time these general terms of sale. In case they would be modified, the terms that were in effect when ordering will prevail on the new ones.

Article 2 : Prices

Prices can be modified by Jolilola at any moment, but we commit ourselves to invoice at the price in effect when your order was registered.
The prices that are mentioned in our catalogue are given in euro and inclusive of all tax in effect on the day your order is placed ; any change in the taxes will reflect on the prices of our items and services.
The prices we mention are exclusive of charges for ordering processes, transport and delivery as long as these take place in the geographical area mentioned below.

Items and services delivered by Jolilola are available all around the world. Please have a look at the payment and delivery rules proposed for your country.

Article 4 : Characteristics of delivered items and services

The items and services we propose are those mentioned in the catalogue which is published on www.jolilola.com website.
These items and services are subject to stock availability.
Photographs in the catalogue are as true as possible, but there may be light differences especially in which concerns colours.

Article 5 : Orders

The customer who wants to purchase an item must :
- fill in the identification form in which he/she will mention all the personnal information we ask for or give his/her customer number
- fill in the on line order form specifying all the items references (colour, size, benchmark) ;
- confirm the order after checking it ;
- respect the conditions of payment ;
- confirm his/her order and payment.
Confirming the order implies you agree to the general terms of sale, in their entirety and without exception.
The provided data and registered confirmation will constitute proof of all transactions. Your confirmation will be taken as a signature and agreement with all excecuted processes.
Jolilola will send you an email confirming the order has been registered.

Article 6 : Cancellation

According to the french article L.121-20 and followings of the Code de la Consommation, the buyer has 7 working days from the date of delivery to return any item that would not meet his/her expectations. This will not be invoiced, exept for the cost or return postage.

Article 7 : Payment and security

Prices are due to payment as soon as an order is placed.
You can choose one of theses methods of payment :
- Transfer payment : the customer will receive Jolilola’s bank information in the email confirming his/her order is registered.
The transfer will have to be received on Jolilola’s bank account within 10 days following the order ; in the absence thereof, order will be cancelled and items will be put back on sale.
- Cheque : il will have to be made out to Jolilola. Don’t forget to join it to the order form.
The email you will receive to confirm your order will contain our mailing address and your order number.
The cheque will have to get to Jolilola’s address within 7 days following the order ; in the absence thereof, order will be cancelled and items will be put back on sale.
- Payment by instalments : you can send 3 cheques made out to Jolilola and join them to your order form. No order can be dispatched unless these cheques are received by Jolilola. The deposit will be made as follow :
- First deposit upon receipt
- Second and third deposit 28 days after the first one.
The email you will receive to confirm your order will contain our mailing address and your order number.
The cheques will have to get to Jolilola’s address within 7 days following the order ; in the absence thereof, order will be cancelled and items will be put back on sale.
Credit card : The transaction will be executed through SIPS security system of Atos Worldline which uses the SSL process (Secure Socket Layer) so that the information you transmit are encrypted and no one can have access to credit card details.
- If requested, the customer can receive an invoice on which taxes and item prices will be separated.

Article 8 : Delivery

Delivery will be made to the address indicated in the order form.
Jolilola will not be responsible of any item damage from the moment when these items are commited to the shipping agent or carrier. All loss and damage claims must be addressed to the carrier. Items will be delivered within 2 to 30 days from the day Jolilola receives the payment. A longer delay may be necessary when an ordered item is out of stock In this instance, the customer will be informed when ordering, the ordered items will be left pending until the failing item is available again, except if you agree to pay postage twice.
Postage is automatically calculated according to the order volume and destination country.
7 modes of delivery are proposed :
For France : Colissimo, Colissimo R1, Colissimo R2, Colissimo R3
For Europe : International Colissimo
Or the parcel can be directly withdrawn at Jolilola’s home.
For deliveries in France, please choose the type of colissimo that will offer an insurance in accordance with the amount of your order.
Colissimo : offers an integrated fixed insurance of 16 euros in case of loss, plundering or damage.
The parcel will be left in the recipient’s letterbox. No signature is required. If the recipient is absent, or the letterbox too small to contain the parcel, a non-delivery notice will be left instead to indicate the address of the postoffice where the parcel can be collected.You will then have fifteen days to go and pick you parcel. After this period, il will be sent back to Jolilola.
You can track your parcel on this website and find out when it is received.
Delay for France : 48 hours if you respect deposit hours.
Colissimo R1 : offers an integrated fixed insurance of 31 euros in case of loss, plundering or damage.
The parcel is delivered against signature. If the recipient is absent, a non-delivery notice will be left instead to indicate the address of the postoffice where the parcel can be collected.You will then have fifteen days to go and pick you parcel. You can track your parcel on this website and find out when it is received.
Colissimo R2 : offers an integrated fixed insurance of 153 euros in case of loss, plundering or damage.
The parcel is delivered against signature. If the recipient is absent, a non-delivery notice will be left instead to indicate the address of the postoffice where the parcel can be collected.You will then have fifteen days to go and pick you parcel.
You can track your parcel on this website and find out when it is received.
Colissimo R3 : offers an integrated fixed insurance of 458 euros in case of loss, plundering or damage.
The parcel is delivered against signature. If the recipient is absent, a non-delivery notice will be left instead to indicate the address of the post office where the parcel can be collected.You will then have fifteen days to go and pick you parcel.
You can track your parcel on this website and find out when it is received.
International Colissimo : The parcel will be delivered against signature. If the recipient is absent, a non-delivery notice will be left in his/her letterbox (You can track your parcel from sending to delivery) on this website for the following destinations : Germany, Austria, Belgium, Denmark, Spain, Finland, Hungary, Norway, Netherlands, Poland, Portugal, Czech Republic, United Kingdom and Northern Ireland, Slovakia, Slovenia, Sweden, Switzerland, Tunisia, USA.
Delays for France : 48 hours if you respect deposit hours.
You can also come and collect your parcel : please send us an email via “contact us” to make an appointment BEFORE ordering.
You can collect your order in a “relay mum” home : Your parcel will be sent to a “relay mum” home, close to where you live, with no additional postage fee. Parcels sending only takes place once or twice a month. If the item you need is out of stock, we will send it as soon as we have it available again.
Before any on line order, you should contact the relay mum via our Relay Mum Map.
When confirming the mode of delivery that is most suitable to you, please indicate the town and forename of the relay you chose.

Article 9 : Warranty

All items offered by Jolilola are insured by the legal warranty set by articles 1641 and following of french civil code.
In case an item would be nonconformed, it will have to be sent back to Jolilola and it will be taken back, changed or reimbursed.
Any claim, ask for exchange or reimbursement will have to be posted to the following address : Jolilola, 9 Rue Victor Ladeveze 64000 Pau whithin 30 days following delivery.

Article 10 : Responsibility

Jolilola, in the process of on line sale, is only bound to provide means ; no responsibility will be committed for a damage that would result from the use of internet, such as data loss, intrusion, virus, or other unintentional problem.

Article 11 : Intellectual property

Jolilola is a registered trademark. All elements of Jolilola website are and keep being the exclusive intelectual property of Jolilola.
No authorisation is given to copy, commercialize, distribute or use, even partly, the elements of this site, be they softwares, visual or sound elements. Any simple or hypertext link is strictly forbidden without the expres writen agreement of Jolilola.

Article 13 : Clauses of “Computer and freedom law”

In accordance with Computer, Data and Freedom law (6th of January 1978), nominative information about customers can be object of automated treatment.
Jolilola reserves the right to collect information about customers, including by using cookies.
Jolilola will not divulge personnal information provided by customers to any commercial partner.
In accordance with the law of the 6th of Januyary 1978, customers will be granted the right to have an access and to modify the personal information they provide.
The automated treatment of information, including the management of customers email addresses, was registered by the CNIL (National Commission for Computer and Freedom) on the 21rst of December 2005 under number 1137072.
Filing – Proof Jolilola will file order forms and invoices on a reliable and enduring support that will constitute a true copy in accordance with Article 1348 of civil code.
Jolilola’s computer registers will be considered by both partners as an evidence of all communication, orders, payments and transactions.

Article 13 : Dispute resolution

Present conditions of sale are subjected to French law.
In case of litigation, the parties submit to the jurisdiction of Pau, despite plurality of respondants or appeal on warranty.

Article 14 : Customers comments

You can drop comments on Jolilola website. Their contents must not be illegal, subversive, obscene, abusive, threatening or libelous. They may not violate intelectual property or be prejudicial to anyone. When you drop comments you allow us to make use of them, to reproduce, adapt, translate and distribute them on any kind of support and all around the world. This is a free sole right.
You declare and certify you are the author of the comment or you have legal rights on it. You attest it will not harm anybody, and if it does, you commit yourself to indemnify Jolilola.
